[00:00:18] Speaker 00: Good morning, Your Honors. [00:00:19] Speaker 00: Eric Ben-Somicon on behalf of Appellee Maria Montero. [00:00:22] Speaker 02: Okay. [00:00:23] Speaker 02: Good morning. [00:00:23] Speaker 02: Well, you brought all that wonderful stuff. [00:00:25] Speaker 02: I don't know if you're going to need much of it. [00:00:27] Speaker 02: We don't have the appellant today. [00:00:28] Speaker 02: We don't know why, but we don't have the appellant, so you can proceed as you like. [00:00:33] Speaker 00: I essentially believe the matters are mooted at this point. [00:00:38] Speaker 00: The property was sold several months ago. [00:00:41] Speaker 00: As ordered by Judge Brand, the proceeds of the sale have been held in trust until further order at the court. [00:00:47] Speaker 00: The appeal as to the broker's employment, I think, is moot as well, not just because the property is already sold, but the broker was vetted by Judge Brand at the trial court level. [00:00:58] Speaker 00: He went through extensive questioning and cross-examination, also by the appellant who is not here. [00:01:04] Speaker 00: I don't see, of course, I'm a little biased being on the side of it, but I don't see any judicial error in any way, shape, or form. [00:01:10] Speaker 02: Or any genuine good faith argument, rather. [00:01:12] Speaker 02: Yeah. [00:01:13] Speaker 02: Yeah. [00:01:15] Speaker 00: And that's it. [00:01:15] Speaker 00: Otherwise, I'll submit on the papers. [00:01:17] Speaker 00: I mean, to the extent they've been filed. [00:01:19] Speaker 01: And the only other issue was the one on the stay violation. [00:01:23] Speaker 01: And there's no dispute that he committed an act. [00:01:27] Speaker 01: Whether it was effective or not is important. [00:01:30] Speaker 01: It was an act. [00:01:31] Speaker 01: He did it. [00:01:32] Speaker 01: He knew the state was in effect. [00:01:34] Speaker 01: He did it anyway. [00:01:35] Speaker 00: A hundred percent. [00:01:36] Speaker 00: And, sorry, even further, the sanction order was never appealed as well. [00:01:42] Speaker 00: And that's already final and, of course, hasn't been satisfied to this day. [00:01:46] Speaker 00: But that sort of goes contrary to the idea that there was judicial error, but the sanction somehow was not appealed. [00:01:53] Speaker 00: And yes, recording all this penance post-petition. [00:01:56] Speaker 00: on property of the estate is an absolute violation. [00:01:59] Speaker 00: I'm actually just for the record, just in case there's any question. [00:02:02] Speaker 00: So with that, if the judges have any questions for me, I'm happy to answer. [00:02:06] Speaker 00: Otherwise. [00:02:07] Speaker 02: I will ask my colleagues if they have any further questions. [00:02:09] Speaker 02: None for me. [00:02:09] Speaker 00: None. [00:02:09] Speaker 00: Thank you very much. [00:02:10] Speaker 02: Thank you. [00:02:11] Speaker 02: Sorry I got to lug that box around. [00:02:13] Speaker 02: Sorry. [00:02:13] Speaker 02: Thank you. [00:02:14] Speaker 02: OK, let's go back up to the top.
